California Probate Process

Learn from a Riverside Probate Attorney

Probate is a court proceeding in which the wishes of a will are carried out. If you are facing the probate process, or if you are nearing the end of your life and you wish to ensure the proper administration of your estate, you need to retain skillful representation. At Sandoval Legacy Group, a Division of Holstrom, Block & Parke APLC, a Riverside probate attorney has the experience to provide you with the results that you desire. We are committed to our clients, and we will work with you from start to finish in order to provide you with the best assistance we can.

Understanding Probate in California

The process begins when an individual passes away. The person who is nominated as the executor will file a petition along with the will, with the court requesting that they be named as executor. Notices are then sent to heirs and relatives informing them of when and where the hearing is to be held. The hearing provides an opportunity for an objection to be heard or for the validity of the will to be contested. If there is no objection and no successful contest of the will, the executor is named, and they begin estate administration.

The executor will then take an inventory of all assets, locate creditors, pay bills, file tax returns, and manage the assets of the estate until they are to be distributed. Once all duties of the executor are complete, a petition is filed requesting that the remaining assets be distributed to the beneficiaries. After this process is complete, final tax returns will be filed, and the probate process is complete. If you are facing this process, or if you wish to prepare an effective will, then you need to seek the representation of our firm. Contact us to schedule your free initial consultation and to get the seasoned legal counsel and guidance you are looking for from a Riverside probate lawyer!
